Outcome: Not Guilty After Trial.

Description: Client charged with Rape of Child 1 found Not Guilty after trial because State not able to prove every element of the charge beyond a reasonable doubt.

Stolen Motor Vehicle Case Dismissed

Date: June 21, 2016

Outcome: Dismissal

Description: Client was not aware car she had purchased of stolen.

Not Guilty Child Molestation 1

Date: May 19, 2016

Outcome: Not Guilty After Trial.

Description: Client charged with Child Molestation found Not Guilty after defense produced evidence there was motive to lie for immigration purposes in order to gain US citizenship.

Robbery Case Dismissed

Date: April 1, 2016

Outcome: Dismissed

Description: Robbery case dismissed in four months.  Client released from custody within days of becoming client.  Case dismissed three months after becoming client.

Marijuana Possession Dismissed after Suppression Motion Filed

Description: Client charged with Possession of a Marijuana, case dismissed after motion filed.

Description: Client’s Felony Assault on an Officer, client found Not Guilty after approximately 45 minutes of deliberation by a Franklin County Jury.

Description: Client found Not Guilty of Theft after only 20 minutes of deliberation by the Jury.

Description: Client charged with Assault Domestic Violence and Malicious Mischief Three, found Not Guilty after Trial of Assault Domestic Violence, finding of Guilty of Malicious Mischief. Sentenced to 3 days with credit.

Description: After being Charge with Two Counts, Vehicle Prowling and Theft, client found Not Guilty after Trial of Theft, finding of Guilty of Vehicle Prowling. Sentenced to 2 days work crew.

Client’s Felony Possession of a Firearm Case Dismissed within One Month

Description: After negotiating with the Prosecuting Attorney and having the client appear only once in court for arraignment, the Prosecuting Attorney agreed to dismiss the case due to lack of evidence.

Client Fount Not Guilty of Possession of a Controlled Substance with Intent to Deliver after Trial

Outcome: Client Not Guilty of Possession of a Controlled Substance with Intent to Deliver Two Month’s After his First Court Appearance.

Description:  The day before trial the Prosecutor made a motion to dismiss the case and re-file it later once evidence identifying the suspected drugs were obtained from the crime lab. Ms. Bennett objected to the motion and the judge found the client Not Guilty the next day at trial when the prosecutor did not have that evidence.

Criminal Weapons Charged Dismissed after Hearing Finding Client Did Not Have Capacity to Commit the Crime

Description: After testimony from the State’s five witnesses, the Court found against the State’s argument that the defendant had the capacity to commit the alleged crime.  Results obtained approximately a week after the criminal charge was filed by the State.

Outcome: Client Not Guilty of Felony Theft – Case Dismissed With Prejudice 3 months from the date criminal charges were filed on the day of trial.

Description: The day this case was scheduled for a trial by jury, the Judge dismissed the case with prejudice due to the multiple acts of negligence by the prosecuting attorney and police officer. 

Client Found Not Guilty of Possession of Stolen Property after Trial

Description: Judge granted motion to dismiss after the State’s case in chief as the State failed to introduce sufficient evidence that my client knew that the property in his home was stolen.

Two Codefendants Charged with Illegal Dumping, Both Criminal Cases Dismissed Without Clients Having to Appear in Court

Description: Two Codefendants charged with Illegal Dumping, a misdemeanor, had both criminal cases dismissed.  One defendant’s case was replaced with a civl infraction with a monetary fine only.  Neither client needed to appear in court at all.

Client Charged with Assault 1 & Facing a Potential Life Sentence in Adult Court, Negotiated for Case to be sent to Juvenile Court with a Plea and 3 months jail.

Outcome: Amended Criminal Charge to Far Less Serious Charge

Description: Client was originally charged with Assault 1 after a stabbing incident.  As charged, client was facing a potential life sentence as he was charged with a Class A felony with Aggravating Circumstances.  Through negotiation with the Prosecutor, my client’s case was moved from adult court to juvenile court and he plead to an amended charge with a 3 month sentence.

 

No Contact Order Dismissed which protected my client’s 4 year old son from him

Description: Client’s former spouse petitioned the court for a No Contact Order protecting their 4 year old son from him. As a result, the father was unable to have any contact with his son for almost a year. Within a month Ms. Bennett, she was able to have the No Contact Order completely dismissed.

Unlawful Issuance of a Bank Check Dismissed Without Client Needing to Appear in Court

Outcome: Case Dismissed prior to Court Hearing and Client Never Required to Appear in Court

Description:  Client was charged with Unlawful Issuance of a Bank Check and through negotiation Ms. Bennett was able to get the case dismissed without my client needing to appear for any of his court dates.

Child Support Granted in Excess of Client’s Expected Amount

Description: Mother seeking child support from children’s father. She stated she wanted a certain monthly amount. The father was not in agreement with that amount and after argument in court she ended up being awarded more than she originally requested.

Minor in Possession Case – Client Found Not Guilty after Trial

Outcome: Not Guilty after trial.

Description: After excluding the prosecutor’s evidence of client’s age and excluding a second officer from testifying at all due to his failure to write a report, the prosecutor was unable to prove every element of the charge and the client was found Not Guilty.

Sexual Misconduct with a Minor

Outcome: Exceptional Downward Sentence

Description: Client was facing a possible life sentence if he lost at trial due to additional charges being filed. Through negotiation, Ms. Bennett reached an exceptional downward sentence with a plea agreement of 17 months instead and no additional charges.

Client Found Not Guilty of Theft and Assault after Trial

Outcome: Client Found Not Guilty on Theft and Assault at Trial

Description: When the accuser did not appear for trial, the Prosecutor requested a continuance and material witness warrant. Ms. Bennett argued against both successfully and the client was found Not Guilty.
